Increasing Population Violating Right to Environment Under Article 21

Abstract
Increasing population is presently biggest menace. Countries with larger population are taking steps to control their number. India too needs to take strict steps. This paper particularly deals with the violation of right to environment which is guaranteed to us as fundamental right under Article 21 of the Indian Constitution. This infringement is due to increasing population’s demands as for fulfilment of these unending demands, more industries are being set up, more vehicles are being used, more resources are being used and exploitation of all resources is at its peak leading to air pollution, water pollution, noise pollution, etc. This shows that there exists nexus between pollution and population. Thus it is clear that increasing population is violating our fundamental right to environment. Apart from the responsibility of the legislators, our honourable Supreme Court is also duty bound to protect our fundamental right so one can approach SC against the infringement of his right to environment and Supreme Court must take necessary actions for the same and that step could be controlling population growth which could be done by restricting the right to procreate. Thus there is a need of balancing the conflicting rights.
